Lead paint testing before a repaint

Testing is not mandatory, but skipping it puts your house in scope by default. What the lead threshold is, who may test, and how a negative result clears a component before scraping starts.

Nobody can make you test. What the rule does instead is quieter and more expensive: absent documentation, an old house is presumed to be in scope, and the whole lead-safe work regime attaches to the job whether or not a single flake of lead is actually present. Testing is the one move that can turn that presumption off, and on a house where the coatings are newer than the framing it very often does.

The details

The state's guidance is admirably direct about this asymmetry. Paint chip sampling recognized — NCDHHS notes that paint testing is not required by the EPA rule, but the requirements apply if you do not hold documentation that the paint is not lead-based. Read that sentence as a procurement instruction rather than a legal one. The default is not 'assume it is clean'. The default is 'act as though it is not, until somebody with a certificate writes down otherwise'.

What counts as lead is a number, and it is worth knowing because it explains why the answer is so often mixed within one building. The threshold is 1.0 mg/cm2 or 0.5% by weight — a coating at or above one milligram per square centimetre, or half a percent by weight, is lead-based paint for these purposes. Below it, the component is out. A 1968 cottage that was stripped to bare cypress in 1994 and recoated with modern acrylic can test clean on the siding and fail on the window sashes nobody ever took apart, because the sashes still carry the original film underneath four decades of top coats.

That component-by-component granularity is the practical value of testing, and it is exactly what the rule contemplates. Certified renovator can test out of RRP before a repaint: a certified renovator working with an EPA-recognised kit tests each painted component the repaint will disturb, and a negative determination documents that component out of scope before a scraper touches it. Six windows in and twenty out is a materially different job from a whole-house containment. The tests are cheap. The containment is not.

Three routes produce a result the program will accept, and they are not interchangeable. An EPA-recognised test kit, used by a certified renovator, gives an immediate answer on site. Paint-chip sampling sends a physical sample to a recognised laboratory, which is slower and more defensible when a sale or an insurer is involved. And instrument testing is a specialist service with a regulatory wrinkle of its own: XRF instruments must be registered in NC, so an XRF gun in use on your porch is a registered radiological device operated by somebody who is accountable for it. A handyman with a hardware-store swab and no certification produces no documentation at all, whatever colour the swab turns.

Timing matters more than most people expect. A test done after the crew has mobilised has already cost you the containment setup; a test done during the estimate can change the scope, the price and the schedule while all three are still negotiable. If you are collecting quotes on a pre-1978 house, ask each bidder whether the number assumes lead work or assumes clean components, because two estimates built on opposite assumptions are not comparable and the gap between them is not a discount.

Test before you price the job, test the components the work will actually disturb, and keep the paperwork with the house. A negative determination is a permanent asset on an old building; an untested assumption is a liability that renews itself every time somebody picks up a sander.
